
KSA Issues Reminder to License Holders Regarding Upcoming Advertising Ban
On July 1, 2023, the Netherlands gambling regulator, Kannspelautoriteit (KSA), will implement a ban on untargeted advertising for online games of chance. The KSA released a clarification about the ban, which aims to protect vulnerable groups from developing gambling addiction. The KSA will ensure compliance for licensed operators, who will have to make their best effort to prevent gambling advertising from reaching minors, young adults, and other vulnerable groups. Advertising in public places will not be permitted, but gambling advertising on the internet, on-demand TV, in social media, or via direct mailing will be allowed under certain conditions. Licensees should be able to demonstrate compliance with the rule that at least 95% of the advertisement target audience comprises adults 24 years or older. Licensees should also monitor the reach of their advertising messages and provide a report to the KSA if requested. Sponsorships fall under the prohibition as a form of untargeted advertising, allowing only a neutral display of the operator logo or name. The KSA will monitor closely the implementation of the new rules and inform license holders if there is a need for further clarifications.
